In the present appeal, it transpires from the impugned order

that the eviction decree in relation to the shop in question was

passed way back on 19.12.1998 wherein appellant was found as

sub-tenant. Thereafter, the appellant has filed objections under

Order 21 Rule 97 CPC claiming himself to be the tenant in the suit

shop. His objections has been dismissed on merits vide order

dated 13.12.2017 which has been affirmed in appeal vide

judgment dated 10.10.2019.

Since, no one has appeared on behalf of appellant to argue

the appeal, in the interest of justice, list this second appeal again

on 05.05.2022.
