Learned counsel for the parties are in agreement that the

controversy involved in this writ petition is identical to that of SB

Civil Writ Petition No.5533/2020 and other connected matters

decided by the Coordinate Bench of this Court on 15.03.2021.

In view of the above, this writ petition is disposed of with a

directions to the State to hold election of the petitioner as early as

possible, however, in any case not later than six months from

today.

Till the election is held, the present Board of Directors or

member of Executive Committee of petitioner-Society shall

continue to hold office(s), if it does not acquire any

disqualification.

It is further directed that the Board of Directors will not take

any policy decision in the period interregnum. In case any such

exigency arises, the same shall be taken only after due ratification

by the Registrar, Cooperative Society.

Needless to observe that the present order has been passed

in peculiar situation, as the State was unable to hold the elections

of the petitioner-Society on account of onslaught of Pandemic-

COVID-19.

Stay petition is also disposed of accordingly.
