In respect of order dated 04.02.2022, learned counsel for

the respondent-State submitted that the reply has been filed and

that the respondent No.7 would be looking after the charge of the

Store at the Health & Wellness Center, Bhalikhal, Block

Dhorimanna three times a week and therefore, even if he is

posted 80 kilometers away, the same would not affect his working.

Further submission has been made that even the Doctor is visiting

the Health & Wellness Center from 110 kms away.

It is also claimed that the petitioner can not seek any

direction from the Court as he has already completed 5 years on

the post and by way of a policy decision, the State has decided

that no one shall continue on the post of Storekeeper for more

than 5 years.

In view of the submissions made, seeking to justify the

appointment of respondent No.7 by way of additional charge, who

is otherwise posted 80 kms off the present place and the fact that

respondent No.7 has also appeared in the present petition on his

own, seeking to defend his appointment, which is in addition to

the work he is already performing; prima facie, the same shows

that the process sought to be adopted by the respondents, in

appointing a person 80 kilometers off the place of posting, has

something more than what meets the eyes.

In view thereof, the Director (Non-Gazetted), Medical &

Health Services, Rajasthan, Jaipur is directed to remain personally

present before this Court on the next date.

List the petition on 23.03.2022.
