Vide order dated 16.12.2021 passed in D.B. Criminal Writ

Petition No. 562/2021, this Court had directed the Open Air Camp

Committee to re-examine the case of the petitioner for being sent

to the Open Air Camp in light of the judgments rendered by the

Division Bench of this Court in the cases of Parvezshah Vs. State &

Ors. (D.B. Criminal Writs No.101/2019) decided on 13.03.2019

and Amin Khan @ Aamin Khan Vs. State & Ors. (D.B. Criminal

Writs No.176/2018) decided on 31.05.2018. However, on perusal

of the fresh recommendations dated 19.01.2022, it becomes clear

that the Members of the Committee have totally ignored both the

judgments and rejected the case of the petitioner for being sent to

the Open Air Camp in absolutely laconic perfunctory manner.

Thus, learned Additional Advocate General is directed to

furnish an explanation of the Director General (Jail), Jaipur to

show cause why appropriate action should not be directed for

failing to comply with this Court's order dated 16.12.2021 passed

in D.B. Criminal Writ Petition No. 562/2021.
