Learned counsel for the State submitted that the post of

Additional Chief Block Education Officer was to be filled up on

(2 of 2) [SAW-156/2022]

deputation for a limited period. The petitioner, who had also

applied for being posted as Principal in Mahatama Gandhi (English

Medium) School, was selected and posted on such position.

Subsequently, when he was also shortlisted for deputation to

the post of ACBEO, the Government could not relieve him since

the same would mean leaving the school without a Principal.

Issue notice to the respondent, returnable on 24.03.2022.

By way of ad-interim relief, the impugned judgment of the

learned Single Judge is stayed.
