Heard learned counsel for the applicant for restoration of

S.B. Civil First Appeal No. 467/2017 which was dismissed in

pursuant of per-emptory order passed by this Court on

05.04.2021 for not filing PF and notices for respondent Nos. 1,2,4

& 7.

In the light of Judgment of Hon'ble Apex Court in

Miscellaneous Application No. 665 of 2021 In SMW(C) No. 3

of 2020 IN RE: COGNIZANCE FOR EXTENSION OF

LIMITATION, this application is within time. Hence there is no

need to condone the delay.

Learned counsel for the applicant submits that on account of

difficulties arising out of Covid pandemic, PF and notices could not

be filed within time. Now, he will file PF and notices within a period

of two weeks.

For the reasons mentioned in the restoration application, the

same is allowed. S.B. Civil First Appeal No. 467/2017 is restored

to its original number.

List the matter after compliance.
