Issue notice of the petition as well as stay application. Rule is

made returnable within four weeks.

It is contended by counsel for the petitioners that the

question involved in this case was considered by the Division

Bench of this court in the case of Safi Mohammad & Ors. vs.

State of Rajasthan & Ors. in D.B. Civil writ Petition

No.6024/2021. Any increment which fell due after retirement

could not be given to the retired employee, whereas the Central

Administrative Tribunal has granted notional grade increment to

the respondents. All respondents have retired after the

promulgation of Rules of 2008.

Hence, considering the judgment, we deem it proper to stay

operation of the impugned order.

List after four weeks.
