Mr. C.L. Saini, learned Additional Advocate General appearing

on behalf of the respondents submits that the issue involved in

this writ petition has already been considered and decided by the

Division Bench of this Court in the matter of Jayant Sharma Vs.

State of Rajasthan & Anr. (D.B. Special Appeal (Writ)

No.172/2004) decided on 07th October, 2010.

Counsel for the petitioner has not disputed the submissions

made by the counsel for the respondents.

In that view of the matter, the present writ petition stands

disposed of in view of the judgment passed by the Division Bench

of this Court in the matter of Jayant Sharma (supra).

All the pending applications stand disposed of.
