Learned counsel for the petitioners submits that respondent
has initiated proceedings against the petitioners before National
Company Law Tribunal, so proceedings under Section 138 of N.I.
Act is not maintainable.
Learned counsel for the petitioners has placed reliance upon
the judgments of Hon'ble Apex Court in M/s Nag Leathers Pvt.
Ltd. Vs. M/s Dynamic Marketing Partnership (Criminal
Appeal No.1424/2021 (Arising out of SLP (Crl.)
No.9077/2019)) decided on 18.11.2021 and P. Mohanraj &
Ors. Vs. Shah Brothers Ispat Private Limited reported in
(2021) 6 SCC 258.
Issue notice to respondent No.2, returnable within four
weeks.
List after four weeks.
Meanwhile, operation of the order dated 24.01.2020 pending
before Special Metropolitan Magistrate (N.I. Act Cases) No.2,
(2 of 2) [CRLMP-46/2022]
Jaipur Metropolitan, Jaipur titled Shriram City Union Finance Ltd.
Vs. Aseem Ispat Pvt. Ltd. & others shall remain stayed.
