Appellant-plaintiff has filed this first appeal feeling aggrieved by
the impugned judgment and decree dated 11.04.2022 passed by
learned Additional District Judge, Tonk in Civil Suit No.36/2012
(14/2010) whereby her civil suit for specific performance has been
dismissed.
Learned counsel for appellant submits that respondent is in
possession of the property in question. He further submits that the trial
court has found proved the execution of agreement through which
against paper sale consideration of Rs.1,00,000/-, Rs.30,000/- was paid
however, has dismissed the civil suit for specific performance.
Heard.
Admit.
Issue notice to respondents of appeal as well as stay application.
Call for the record.
Till further orders, respondents are restrained from creating any
third party interest in the property in question.
