HON'BLE MR. JUSTICE SUDESH BANSAL (V.J.) Order 16/06/2022

Counsel further submits that the cheque in question

was a blank cheque, as issued by the petitioner but the same was

subjected interpolation by the respondent while mentioning the

amount therein and thus, petitioner sought FLS report on the

aspect of the forgery in question. Counsel for petitioner further

submits that petitioner-accused has a right of defence and prayer

for sending the cheque to FSL is well within his right of defence,

which has wrongly been denied.

Issue notice to respondent No.2, returnable by four

weeks.

In the meanwhile, learned trial Court shall not pass any

final judgment in the present proceedings.
