1. By way of present petition under Section 482 of the Code of

Criminal Procedure, 1973, the petitioner has challenged the order

dated 23.06.2022 passed by learned Additional Sessions Judge,

Merta (hereinafter referred to as 'the Appellate Court') whereby

petitioner has been asked to deposit a sum of Rs. 2 lakhs within a

period of one month in light of the provision contained in Section

148 of the Negotiable Instruments Act.

2. In light of judgment dated 04.03.2022 in S.B. Criminal

Misc(Pet.) No.189/2022 passed by this Court in the case of G.K.

Construction Company Vs. Balaji Makan Samagri Stores , this

Court does not find any substance and merit in the present

petition.

3. The petitioner is, however, granted limited indulgence of

depositing the amount on or before 31.08.2022.

4. In case petitioner deposits the amount by 31.08.2022, it

shall be treated due compliance of order dated 23.06.2022 passed

by the Appellate Court.

5. The order dated 23.06.2022 passed by the Appellate Court

stands modified accordingly.

6. The present petition so also stay application stands disposed

of accordingly.
