Counsel for the petitioner submits that the present subject
matter is covered by the judgment passed in S.B. Civil Writ
Petition No. 11560/2019 titled as "Hari Kishan Sharma vs. State
of Rajasthan & Ors." decided on 22.07.2020.
Counsel for the respondents does not refute the same.
In view of the ratio as laid downin the judgment, the present
petition is allowed and the impugned order dated 01.07.2019 is
set-aside. It is made clear that the respondents would be at liberty
to proceed against the petitioner in accordance with the rule
governing discipline. It is also made clear that the said disciplinary

proceedings would be conducted after affording opportunity of
hearing to the petitioner and the petitioner would be under an
obligation to co-operate with the Department in completion of the
proceedings. The said departmental proceedings shall be
completed within a period of three months from the date of this
order.
