Pursuant to the directions given by this Court on 04.01.2022,

the Investigating Officer is present in person before this Court

along with the factual report. It is informed by the Investigating

Officer that he has been assigned the investigation in this matter

by the Deputy Commissioner of Police, Jodhpur (East) on

04.12.2021 only.

Having gone through the factual report, I am of the view that

the present as well as the earlier Investigating Officers have not

investigated the matter as per the directions given by this Court

from time to time, particularly on 25.11.2021, whereby the Court

has observed that it is expected from the Investigating Agency to

find out as to who used the e-mail ID for the purpose of operating

the account in question and who has deposited the amount in the

alleged account and who withdrew the same.

The Investigating Officer, present in person, has sought

some more time to conduct investigation in the light of the

directions given by this Court from time to time, particularly on

25.11.2021.

Taking into consideration the above facts and circumstances

of the case, this Court is forced to comment that the Investigating

Officers have not investigated the complaint filed by the petitioner

strictly in a professional manner and the attitude of the

Investigating Officers is very casual.

List the matter on 14.01.2022.

On that day, the Deputy Commissioner of Police, Jodhpur

(East) shall remain present before this Court positively alongwith

the Investigating Officer.
