some time, learned counsel for the petitioner has submitted that

he wants to withdraw this criminal misc. petition, however, seeks

liberty for the petitioner to raise all his defence before the trial

court at appropriate stage.

Accordingly, this criminal misc. petition is dismissed as

withdrawn with liberty sought for.
