The present petition has been filed with the prayer for

consideration of the candidature of the petitioner for the post of

constable in sports quota.

Counsel for the petitioner as well as the respondents has

stated that the controversy in question pertains to the validity of

the sports certificate, which now rests decided by Division Bench

vide judgment dated 19.02.2021 passed in D.B. Special Appeal

Writ No.1349/2019; The State & Ors. Vs. Altaf Hussain & Ors.

Counsel for the respondent states that in view of the Division

Bench judgment, the present writ petition deserves to be

dismissed.

Counsel for the petitioner has although agreed to the fact

that the controversy has been decided in Altaf Hussain's case

(2 of 2) [CW-13083/2018]

(supra) but he has submitted that the same certificates which had

been refused to be considered in the recruitment process of 2018

are being considered in the recruitment process of 2019.

Counsels submits that there cannot be a discrepancy qua the

same certificate.

In view of the fact, he prays for time to place on record the

documents vide an additional affidavit.

Time prayed for is granted.

List the matter on 03.02.2022.

Application for preponement of date of listing of the case

stands disposed of.
