This writ petition has been filed by the petitioner seeking a

direction to the respondents to consider the eligibility of the

petitioner after providing 20% relaxation in the minimum passing

marks in REET Examinations for the purpose of recruitment for the

post of Teacher Gr.III (Level-II) for the subject Social Science

pursuant to the advertisement dated 31.7.2018.

It is submitted by learned counsel for the petitioner that the

issue raised in the present petition is squarely covered by

judgment in Ranu Pandya & Ors. v. State of Rajasthan & Ors.:

(2 of 2) [CW-16267/2021]

S.B. Civil Writ Petition No.21060/2018, decided 9.12.2021 at

Jaipur Bench and followed in Hemendra Kumari Chouhan v. State

of Rajasthan & Ors.: S.B. Civil Writ Petition No.18114/2021,

decided on 10.2.2022.

Learned AAG appearing for the respondents made

submissions that though the issue raised by the petitioner is

squarely covered by judgment in the case of Ranu Pandya &

Hemendra Kumari Chouhan (supra), however, as the petitioner

has obtained 45.1695% marks and the cut-off in petitioner's

category is 69.350%, the petitioner even otherwise is not entitled

to any relief.

In view of the above fact situation, though the petitioner is

entitled for relaxation in the minimum eligibility marks, however,

even if the petitioner is treated as eligible for the recruitment, as

the marks obtained by the petitioner are less than the cut-off in

petitioner's category, the petitioner is not entitled to any

consequential relief.

Consequently, the writ petition is dismissed.
