Order

23/02/2022 Learned counsel for the petitioner submits that the

respondents may be directed to consider his case for promotion on

the post of Assistant Engineer in the light of directions issued by

the Hon'ble Apex Court of India vide its judgment dated

28.06.2021 in Civil Appeal No.59/2021: The State of Kerala

and Ors. vs. Leesamma Joseph as also a Division Bench order

of this Court dated 27.10.2021 passed in D.B. Civil Writ Petition

No.8557/2019: Rakesh Kumar Swami vs. State of

Rajasthan & Ors. and another connected matter.

Learned counsel for the respondents has no objection to the

aforesaid prayer.

In view thereof, this writ petition is disposed of with liberty

to the petitioner to submit a fresh representation within a period

of one week from today. The respondents shall decide the same in

the light of judgment of the Hon'ble Apex Court of India in case of

The State of Kerala and Ors. (supra) and a Division Bench order

of this Court in case of Rakesh Kumar Swami (supra) within a

period of four weeks thereafter vide reasoned order with its

intimation to the petitioner.

The pending application stands disposed of accordingly.
