Counsel for the petitioner submits that the respondents have

debarred the petitioner from participating in future tender process

without issuing any show cause notice.

In support of the contention counsel relied upon the

judgment passed by the Hon'ble Supreme Court in the matter of

Gorkha Security Services vs Govt. Of Nct Of Delhi & Ors

reported on 2014 (9) SCC 105.

In that view of the matter, issue notice to the respondent(s),

returnable within six weeks.

Meanwhile, operation of the order dated 10.11.2022 so far

as it relates to debarring the petitioner for a period of six months

from participating the tender process shall remain stayed.
