Learned counsel for petitioner states that the copy of the writ
petition has already been served to respondents.
Learned Additional Advocate General seeks time to file reply
to the writ petition.
Counsel for petitioner states that impugned charge-sheet
dated 23.12.2020 has been issued after delay of 14 years and
more so when in the Inquiry Report of the Committee, petitioner
has not been found guilty for the alleged charges. Reliance has
been placed on the judgment of The State of Madhya Pradesh
Vs Bani Singh [AIR (1990) SC 1308].
Taking into consideration the aforesaid fact, it is hereby
directed that in the meanwhile, operation of charge-sheet dated
23.12.2020 shall remain stayed.
Respondents are free to move application for vacation of
such stay after filing the reply.
