Judgment / Order

08/12/2022

Heard.

This petition has been filed under Article 227 of the

Constitution of India against the order dated 12.05.2021 passed

by Central Administrative Tribunal, Jaipur (hereinafter referred to

as 'the Tribunal'), whereby, O.A. seeking direction to allow the

petitioner to join, has been dismissed.

(2 of 2) [CW-7203/2021]

Learned counsel for the petitioner would submit that the

imperative reason for the petitioner not to join services was illness

of his father and this was not properly appreciated by the Tribunal.

We find that after the appointment order was issued to the

petitioner and not only once but more than one opportunity was

granted to the petitioner and in this manner repeatedly a total

period of six months was allowed to the petitioner to join services

even then, he failed to join. The view, therefore, which has been

taken by the Tribunal does not suffer from any patent illegality or

error of jurisdiction, warranting interference by this Court.

This petition is, accordingly, dismissed.
