Heard.

Shri Kumbhat submits that the learned Single Bench has

allowed the writ petition of the respondent by relying on the

Single Bench judgment in the case of Fauran Singh vs. Rajasthan

University of Health Sciences & Anr. (S.B. Civil Writ Petition

No.10298/2019, decided on 31.07.2020). He drew the Court's

attention to the order dated 08.12.2022 passed in bunch of

special appeals (writ) led by D.B. Special Appeal Writ No.772/2021

(Rajasthan University of Health Sciences, Jaipur vs Mahesh Joshi)

by Division Bench at Jaipur whereby, the Single Bench judgment

in the case of Fauran Singh (supra) has been reversed.

Issue notice of the appeal as well as the stay application to

the respondents. Rule is made returnable in four weeks.

In the meantime, the effect and operation of the order dated

05.12.2022 in S.B. Civil Writ Petition No.17144/2021 shall remain

stayed.

List after four weeks.
