Learned counsel for the petitioner relies on the judgment in

Sampat Kumar vs. Ayyakannu & Anr. : 2003 (1) RLW 49 (SC) and

Revajeetu Builders & Developers vs. Narayanaswamy & Sons &

Ors.: 2010 (1) RLW 322 (SC) to contend that rejection of the

application by the trial court seeking amendment in the plaint is

not justified.

In view of the submissions made, issue notice. Issue notice

of the stay application also. Notices are made returnable within

four weeks. Notices when issued be given 'dasti'.

In the meanwhile and till further orders, further proceedings

in Civil Original Suit No. 34/2019 pending before Senior Civil

Judge, Sagwada, District Dungarpur shall remain stayed.
