The matter comes upon an application seeking correction in

the order dated 18.11.2022 passed by this Court in S.B. Criminal

Misc. Petition No. 5631/2022.

Learned counsel for the applicant submits that in the

operative portion of the order dated 18.11.2022, instead of

"seized articles", the word "vehicle" has been incorporated.

It seems that due to inadvertence, an error has occurred in

the order aforesaid which is required to be rectified in the interest

of justice.

Accordingly, the instant Misc. Application is allowed.

The operative portion of the order dated 18.11.2022 shall

now be read as under:-

                                         "Considering    the     submissions           and      following   the

judgment rendered by Hon'ble the Supreme Court in

the case of Sunderbhai Ambalal Desai Vs. State

of Gujarat, reported in (2002) 10 SCC 283, the

petition is allowed and this Court deems it just and

appropriate to release the seized articles in favour of

the petitioner provided he furnishes a Supurdaginama

of Rs. 25,000/- and surety of like amount to the

satisfaction of the Court below."

This order shall be treated as part and parcel of the order

dated 18.11.2022.
