the respondents were directed to decide the representation of the

petitioner in the light of judgment in Manvendra Singh vs. State of

Rajasthan & Ors. : S.B.C.W.P. No.4276/2018 decided on

21.12.2018.

The representation made by the petitioner came to be

rejected on 07.02.2022 (Annex.8) by Mr. Anand Sharma,

Superintendent of Police, Sri Gangangar inter-alia observing as

Feeling aggrieving the petitioner approached this Court by

filing CWP No.2828/2022, which came to be decided on

28.06.2022 (Annex.9) wherein, it was observed and directed by

this Court as under:

"From the decision of the Division Bench, it is apparent that insofar as the ratio of judgment in the case of Manvendra Singh (supra) regarding the power of the competent authority under Rule 13(5) being not restricted by the Circulars issued by the State is concerned, the same was upheld and, therefore, the determination made by order impugned dated 7.2.2022 (Annex.8) by the competent authority cannot be sustained.

Admittedly, in the present case the charge-sheet against the petitioner has already been filed on 24.11.2021 and thereafter the petition was filed before this Court and representation was directed to be decided by order dated 24.1.2022.

In view of the above discussion, the petition filed by the petitioner is allowed. The order dated 7.2.2022 (Annex.8) is quashed and set aside. The matter is remanded back to the competent authority to pass a fresh order keeping in view the observations made hereinbefore regarding the powers being not restricted by Circular

dated 23.2.2015 as observed by the Division Bench and pass appropriate order.

Needful may be done by the competent authority within a period of three weeks from the date a copy of this order is placed by the petitioner with the competent authority."

Now, again an order dated 14.07.2022 (Annex.10) has been

passed by same officer i.e. Mr. Anand Sharma, Superintendent of

Police, Sri Ganganagar observing as under:

A perusal of the reasoning given in both the orders would

indicate that the same are pari materia and despite specific

observations made by the Court on 28.06.2022, totally oblivious

of the said observations, the order has been passed. It appears

that the officer has chosen to ignore the observations made by the

Court for reasons best known to him.

List the petition on 19.12.2022, on which date, the

respondents shall keep said Mr. Anand Sharma, Superintendent of

Police, Sri Ganganagar present before the Court.
