Counsel for the petitioners submits that the issue involved in
these writ petitions has been considered and decided by the Co-
ordinate Bench of this Court at Principal Seat, Jodhpur in the
matter of Narendra Singh Chouhan Vs. Rajasthan Public Service
Commission, Ajmer (S.B. Civil Writ Petition No. 2396/2022)
wherein on 11.07.2022 following order was passed;
"This writ petition has been filed by the petitioner seeking a direction to the respondent- Rajasthan Public Service Commission (RPSC) to award marks to the petitioner for the questions, which remains unchecked during the course of checking of the answer sheet and grant consequential relief to the petitioner pertaining to his merit.
The petitioner participated in the Rajasthan Administrative Services Combined Competitive Examination-2018 and was awarded marks and ultimately selected in Rajasthan Minority Affairs Services. When the petitioner obtained certified copy of his answer sheets, it was noticed that certain questions remained

unchecked and based on which the petitioner approached the RPSC and filed the present petition.
During the course of present petition, RPSC has undertaken the exercise of checking the answer sheets of the petitioner and has found that the submissions made in this regard are correct and has awarded marks, however, on account of certain other circumstances, the respondent- RPSC presently is not in a position to give effect to the revision in the marks.
Learned counsel appearing for RPSC made submissions that as soon as such stage, on account of which the revised result cannot be declared by the respondent is over, the needful will be done in the case of the petitioner. It is further assured that revised marks of the petitioner will be reckoned for ascertaining the merit position and that the final select list will be issued only after considering the petitioner's revised marks.
In view of above fact situation, wherein the marks have already been awarded to the petitioner for unchecked questions and the learned counsel for the RPSC, on instructions has given assurance before the Court as noticed herein before, nothing survives in the petition and the same is disposed of reiterating the submissions made by the counsel for RPSC that the petitioner's' amended marks given after checking of the unchecked questions, shall be reckoned and the revised select list/merit list shall be prepared accordingly and the petitioner would be accorded the consequential benefit of such revision of the marks."
Counsel for the respondent-RPSC has not disputed the
submissions made by the counsel for the petitioners.
In that view of the matter, these writ petitions stand
disposed of in view of the judgment passed by the Co-ordinate
Bench of this Court at Principal Seat, Jodhpur in the matter of
Narendra Singh Chouhan (supra).
