Mr. A.K. Sharma, Sr. Advocate with Mr. Rachit Sharma,

Advocate appears on advance copy on behalf of the respondents.

Though, learned counsel for the appellant would submit that

the appellant having already appeared in the examination and

result awaited, he ought not be denied the status of a student

entitled to contest the election and that in one of such cases, an

interim order has already been passed on 18.08.2022 in S.B. Civil

(2 of 2) [SAW-1008/2022]

Writ Petition No. 12092/2022, on the face of Clause 20(c) of the

Constitution of the Rajasthan University Students' Union 2017

which provides that a failed student is disqualified to contest the

election, the aforesaid submission of learned counsel for the

appellant cannot be accepted.

On that ground alone, we are not inclined to interfere with

the order passed by learned Single Judge, though prayer for stay

has been rejected on other grounds.

Accordingly, this appeal is dismissed.
