HON'BLE MR. JUSTICE INDERJEET SINGH Order

17/08/2022 Heard on the application (1/2022) for vacation of the interim order dated 12.01.2021 passed by this court.

Counsel for the respondents has relied upon the judgment passed by the Division Bench of this court in the matter of 'State of Rajasthan & Ors. Vs. Narayan Lal Gurjar' (D.B. Special Appeal No.793/2019) decided on 31.05.2019.

Counsel for the petitioner submits that the issue involved in this writ petition is pending consideration before the Hon'ble Supreme Court.

Heard counsel for the parties and perused the record. In my considered view, the circular dated 13.01.2020 was issued in compliance of the order dated 31.05.2019 passed by the Division Bench of this court in D.B. Special Appeal Writ No.793/2019.

In that view of the matter, the stay vacation application filed on behalf of the respondents is allowed and the interim order dated 12.01.2021 is hereby vacated.
