Let notice should go to respondent No.2, through both the
process.
Requisites be filed within 10 days.
Learned Public Prosecutor accepts notice on behalf of the
State-respondent.
The petitioner has sought for quashment of FIR No.483/2022
registered with Police Station Kotwali Sikar for the offence under
Section 384/506 of IPC.
Submission is that though there is allegation of demand of
ransom but ransom was not paid in pursuance of the demand,
hence offence of extortion is prima-facie not made out. Reliance
has been placed on the judgment of Hon'ble Supreme Court in
Isaac Isanga Musumba and Ors. vs. State of Maharashtra
and Ors. reported in (2014)15 SCC 357.
Considering the submission aforesaid, it is directed that
petitioner shall not be arrested in the aforesaid FIR, till further

order with condition that petitioner shall fully co-operate with the
investigation of this case.
