The matter comes up for consideration of

application (03/22) preferred on behalf of petitioners

seeking correction in the order dated 16.8.2022 passed

by this Court in SBCWP No.3774/2008.

For the reasons mentioned the aforesaid application,

the same is allowed and it is hereby directed that the

order dated 16.8.2022 passed by this Court in SBCWP

No.3774/2008 shall now be read as under :

"The matter comes up for consideration of the application preferred on behalf of the petitioners under Order 5 Rule 20 C.P.C. for substituting service upon the respondent Nos.6/2 and 6/3.

                                             Having     gone       through        the      report   of

process server, this Court does not find that the respondent Nos.6/2 and 6/3 are avoiding service of summon issued to them.

In the facts and circumstances of the case, I deem it proper to issue fresh notice to the respondent Nos.6/2 and 6/3. Notices are made returnable on 21st of Sept., 2022. Requisites be filed in two sets. One set be given 'dasti' and another be sent through registered post with acknowledgment due.

The application (No.02/2019) filed by the petitioners under Order 5 Rule 20 C.P.C. shall be considered at later stage.

The applications No.2/22 and 1/2021 are disposed of."

Ordered accordingly.
