It is submitted by learned counsel for the petitioner that the

petitioner is due to retire on 28.02.2023 and he has been

transferred from Deedwana to Nokha, which action of the

petitioner is contrary to the judgment in the case of Dr. (Smt.)

Pushpa Mehta v. Rajasthan Civil Services Appellate Tribunal &

Ors. : D.B. Special Appeal (Writ) No.11538/1999, decided on

16.12.1999.

Further submissions have been made that no one has been

posed in place of the petitioner.

In view of the submissions made, issue notice. Issue notice

of the stay application also, returnable in four weeks.

Notices when issued be given 'dasti' to counsel for the

petitioner.

In the meanwhile and until further orders, the effect and

operation of the order dated 20.07.2022 (Annex.3) qua the

petitioner, shall remained stayed.
