Learned counsel for the petitioner submits that the

controversy in question rests decided by the judgment passed in

S.B. Civil Writ Petition No. 27795/2018; Lokesh Kumar

Gurjar v. The State of Rajasthan & Ors. (decided on

02.07.2020) which has been affirmed by the Division Bench in

D.B. Special Appeal (Writ) No. 591/2020; The Rajasthan

Public Service Commission v. Lokesh Kumar Gurjar (decided

on 01.09.2021).

Learned counsel for the respondents is not in a position to

refute the above position.

In view thereof, the present writ petition is allowed. The

respondent Authorities are directed to consider the candidature of

the petitioner according to his merit and treat him to be eligible

for the purpose of appointment on the post of LDC. The

respondents shall accordingly pass necessary orders for

consideration of the appointment of the petitioner, if he is

otherwise found eligible and in accordance with his merit. The said

exercise may be completed within a period of three months from

the date of receipt of the copy of the present order.

All the pending applications also stand disposed of.
