     In wake of instant surge in COVID-19 cases and spread of its

highly infectious Omicron variant, abundant caution is being

maintained, while hearing the matters in Court, for the safety of

all concerned.

     Learned counsel for the appellant has preferred the present

appeal claiming the following reliefs:-
    "It is therefore, humbly prayed that the leave to appeal
    may kindly be granted and appeal be allowed and the
    impugned judgment/order dated 30.06.2014 may kindly
    be quashed and set aside and the accused respondent
    may kindly be convicted and sentenced as per provisions
    of law."

     Learned counsel for the appellant submits that the offence

was committed two times and learned trial court should have

taken a very serious view, rather than acquitting the accused-

respondent on the count that it was a first offence.

                                         Learned counsel for the respondent submits that amount of

                                   Rs.65,000/- has already been paid on count of default.

                                         This Court, on being satisfied that the amount of Rs.65,000/-

                                   has been paid by the accused-respondent, is not inclined to allow

                                   the present appeal. The impugned order of learned trial court does

                                   not suffer from any infirmity, thus, the present appeal is

                                   dismissed.

                                         All pending applications also stand dismissed accordingly.
