1. Mr. Bhatnagar, learned counsel for the petitioner submits that

the petitioner had offered draft of the cheque amount and

requested the Court to drop the proceedings against him,

however, the Court has not dropped the proceedings, because the

complainant showed his disinclination to settle the case.

2. Learned counsel relies upon the judgment of Hon'ble the

Supreme Court in the case of Meters & Instruments Pvt. Ltd

(M/s.) & Anr. Vs. Kanchan Mehta reported in 2017 Cr.L.R. (SC)

1043 and submits that the petitioner is prepared to reasonably

compensate the complainant.

3. Issue notice. Issue notice of stay application, returnable

within four weeks.

4. Meanwhile, further proceedings in Criminal Case No.06/2021

(Bhimraj Vs. Shivnarayan) pending before the Special Judge,

N. I. Act Cases, Rajsamand shall remain stayed.
