On the last occasion, directions were issued to serve a copy
of the petition on Mr. Pankaj Sharma, AAG.
Mr. Sharma appears and states that the Department of
Elementary Education has no role in the present matter and
effective party is the respondent No.4 The Shiksha Karmi Board,
who is already represented.
In view of the same, it is made clear that Mr. Sharma would
not be required to appear in the matter.
Counsel for the petitioner submits that the controversy in
question stood decided by the judgment passed in Laxman Singh's
case but the said judgment has been challenged by the State of
Rajasthan in D.B.S.A.W. No.27/2021 (State of Rajasthan Vs.
Laxman Singh) and notices have already been issued in the said
matter.
Counsel therefore submits that in view of the subsequent
developments, the present petition be adjourned and be listed
after a period of four weeks.
