HON'BLE MR. JUSTICE MANOJ KUMAR GARG
Judgment / Order
01/04/2022
The present bail application has been filed under Section
439 Cr.P.C. The petitioner has been arrested in connection with
F.I.R. No.94/09, Police Station Kotadi, District Bhilwara, for the
offences punishable under Sections 394, 411/34 of the I.P.C. and
Section 3/25 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner
is innocent and he has falsely been implicated in this case. The
petitioner is in judicial custody and trial of the case will take
sufficient long time. Therefore, the benefit of bail should be
granted to the accused-petitioner.
Learned Public Prosecutor has opposed the bail application.
From perusal of the case diary, it appears that so many
cases have been registered against the petitioner. Thus, no case
for grant of bail is made out.
(2 of 2) [CRLMB-4023/2022]
Accordingly, this Criminal Miscellaneous Bail Application is
dismissed. The trial court is directed to expedite and conclude the
trial as early as possible.
