By way of this writ petition, the petitioner has raised

a grievance that it had filed application for recognition of

D.El.Ed. Course, however, the same has not been decided

and is pending consideration before the Western Regional

Committee.

Mr. Pooshan for Mr. Vivek Shrimali, learned counsel

appearing for NCTE, on the other hand, submits that

maybe the petitioner's assertion is correct that he has

filed application, however, since the application was filed

many years ago, the NCTE is not having

particulars/whereabouts of that application which is

allegedly pending.

He further submits that NCTE has taken an in

principle decision to process all the applications for

recognition subject, of course, to the following

conditions :-

"1. Affidavit on Rs.100 stamp paper from the President/Secretary of the Management duty notarized giving the details of applications pending with NCTE and also the existing courses being run by the management on the same land where this application is proposed, as per format approved by WRC.

2. To submit the proof of submission of initial application to NRC in original, self-attested.

3. To submit the proof of rejection of initial application by NRC in original, duly self- attested.

4. To submit the proof of payment of processing fee at the time of initial application, self-attested (photocopy of DO/Bank Statement/Certificate from Bank etc)."

Mr. Pooshan for Mr. Vivek Shrimali, learned counsel

for the NCTE assures that on fulfilling the aforesaid

conditions, the petitioner's application shall be processed

by the NCTE, expeditiously, preferably within a period of

12 weeks from the date of fulfilling all the formalities and

conditions.

Considering the assurance given by learned counsel

for the respondents, this writ petition is disposed of with

a direction to the Western Regional

Committee/Competent Authority to consider petitioner's

application for grant of recognition on fulfilling the

condition mentioned in para (3) above, in accordance

with law, as early as possible, preferably before

31.05.2022.

Stay application also stands disposed of accordingly.
