        None appears on behalf of appellants.

This appeal has been filed by and on behalf of Jaipur Vidhyut

Vitran Nigam Limited (JVVNL) assailing the judgment and award

dated 04.08.2021 passed by court of Civil Judge, Alwar in civil

misc. application (fatal accident) No.56/2017 whereby and

whereunder compensation to the tune of Rs.11,30,504/- with

interest @6% per annum has been awarded in favour of

claimants.

Learned counsel for appellants did not appear yesterday i.e.

27.04.2022 and has not appeared today also i.e. 28.04.2022.

However, considering the nature of dispute, the first appeal

is admitted for hearing.

In case, appellants deposit entire amount of compensation

with interest within a period of four weeks before the trial court, if

already not deposited, the execution proceedings of impugned

award shall remain stayed. Out of compensation so deposited by

appellant, 50% amount of compensation be disbursed to

respondents through their saving bank account in terms of award

and remaining 50% amount of compensation shall remain deposit

in FDR in a nationalised bank initially for a period of three years

subject to renewal from time to time. It is needless to say that, in

case appellant fails to deposit the amount within the aforesaid

period, respondents-claimants may proceed for execution.

The trial court may first complete the exercise of deposition

and disbursement of compensation as mentioned hereinabove and

thereafter shall send the record to this Court.

A copy of this order be sent in the office of appellants.
