Order

27/04/2022

Matter comes-up on an application filed under Sections 151

& 152 of CPC for correction of the judgment dated 04.09.2020

passed by this Court in S.B. Civil Misc. Appeal No.915/2014.

(2 of 2) [CMAP-25/2022]

Learned counsel for applicants/appellants submits that this

Court vide its judgment dated 04.09.2020 partly allowed the

appeal. Accordingly, the impugned judgment and award dated

24.09.2013 passed by the Tribunal was modified and the

claimants were held entitled to receive an amount of

Rs.18,71,304/- instead of Rs.14,73,907/- as compensation.

Learned counsel further submits that the Tribunal while passing

the judgment and award dated 24.09.2013 also awarded a sum of

Rs.58,027/- towards medical bills, but due to typographical error

the said amount was not included in the enhanced amount of

Rs.18,71,304/-. Hence, the judgment dated 04.09.2020 passed by

this Court needs to be modified/corrected.

Heard. Considered.

Taking into consideration the facts and circumstances of the

case as also the relevant material on record, the application is

allowed; the judgment dated 04.09.2020 passed by this Court is

modified and the claimants are held entitled to receive an amount

of Rs.19,29,331/- (Rs.18,71,304/-+Rs.58,027/- towards medical

bills) instead of Rs.18,71,304/-. Rest part of the judgment dated

04.09.2020 passed by this Court shall remain unchanged and this

order shall be treated as an integral part of the judgment dated

04.09.2020 passed by this Court.
