1. Learned counsel for appellant submits that appellant-plaintiff

has filed a civil suit alleging inter alia that Rajasthan Finance

Corporation has already entered into compromise with

respondent-defendant No.3 however, he inclined to proceed

against the appellant whereas the appellant had retired from the

partnership firm.

2. During course of appeal, the appellant has moved an

application (I.A. No.1/2022) purportedly under Section 151 CPC

alleging inter alia that now the dispute has been settled between

the parties and appellant does not want to pursue the first appeal

and seeks permission to withdraw the same.

3. In view of above, the permission is granted. The appeal is

dismissed as withdrawn.

4. Stay application as well as any other pending application(s),

if any, stand(s) disposed of.
