1. Accused-applicant has preferred this second application for

suspension of sentence.

2. Heard on second application for suspension of sentence.

3. It is contended by counsel for the applicant that the first

application for suspension of sentence was dismissed as

withdrawn vide order dated 06.08.2019. Now second application

for suspension of sentence has been filed before the Court on the

ground that the applicant is in jail since more than six years.

4. Learned Additional Government Advocate has opposed the

application for suspension of sentence.

5. We have considered the contentions.

6. Looking to the statement of the prosecution witnesses and to

the allegations levelled against the applicant that there was

demand of dowry of Rs.25,000/- soon before death of deceased

and a sum of Rs.5,000/- was given to the accused-applicant soon

before death of deceased and death of the deceased has occurred

under unnatural circumstances within seven years of the date of

marriage & no explanation whatsoever has been given by the

applicant in his statement recorded under Section 313 Cr.P.C. and

also taking into consideration the gravity of the matter, we are not

inclined to entertain the second application for suspension of

sentence .

7. Accordingly, the second application for suspension of

sentence is dismissed.
