Order
06/04/2022 This appeal has been filed by Insurance Company, assailing
the judgment and award dated 17.11.2021 passed in claim case
No. 210/2018 (CIS No.210/18) by Motor Accidents Claims
Tribunal, Tonk.
Heard.
Admit.
Issue notice.
On the request of learned counsel for the appellant, service
of respondent Nos.2 and 3 is dispensed with. Notice be issued to
respondent No.1 only.
Heard on stay application.
In case, appellant-Insurance Company deposits entire
amount of compensation with interest within a period of four
weeks before the Tribunal, the execution proceedings of the
impugned award shall remain stayed. Out of compensation so
deposited by appellant, 50% amount of compensation may be

disbursed to respondent-claimant through his saving bank account
in terms of award and remaining 50% amount of compensation
shall remain deposit in FDR in a nationalised bank initially for a
period of three years subject to renewal from time to time.
The Tribunal may complete the exercise of deposition and
disbursement of compensation as mentioned above and
thereafter send the record to this Court.
