Learned counsel for the appellant prays that the

respondents be directed not to alienate the property in dispute.

During the course of arguments, learned counsel has

placed reliance on the judgment passed by the Apex Court in the

case of Kaliaperumal Vs. Rajagopal & Anr. reported in

((2009) 4 SCC 193).

Issue notice of the appeal as well as stay application,

on doing the needful, returnable within four weeks.

Notices be given 'dasti', as prayed.

Meanwhile, the respondents are restrained not to

alienate the property in dispute, till the next date.

The interim stay shall be effective only after service

upon the respondents.
