Present petition arises out of order dated 07.04.2021

passed by the Central Administrative Tribunal, Jaipur Bench, Jaipur

(for short 'the Tribunal') in original application filed on behalf of a

large number of railway employees in the accounts cadre seeking

benefit of revised pay scale with effect from the date

recommendations for revision were made, i.e, with effect from

01.01.1996.

Learned Tribunal relied upon the decision dated

18.12.2019 of Delhi High Court in the case of All India Railway

Accounts Staff Association and Others Vs. Union of India & Others,

WCP No. 1523/2016.

Learned counsel for the petitioners has fairly stated

that SLP filed against the said judgment has also been dismissed.

We find that in the order passed by the Delhi High

Court, order dated 07.03.2003 of the Railway Board to the extent

it limited the actual benefit of revised pay scale by granting the

same from 02.02.2003 and not from 01.01.1996 has been set

aside.

It was on the strength of this order that the benefit was

extended in limited manner and not from 01.01.1996. Since that

order has now been set aside, the Tribunal was left with no option

but to allow the original application.

The argument that the original application before the

Tribunal was filed with delay cannot be accepted because Delhi

High Court had allowed the petition and even order dated

07.03.2003 of the Railway Board has been set aside. Original

application remained pending since 2015 before the Tribunal.

Once order dated 07.03.2003 of the Railway board has been set

aside to the extent indicated in para 23 of the order passed by

Delhi High Court, the Tribunal could not have and has rightly not

dismissed the original application on the ground of delay.

In view of above, there is no merit in this petition and

the same is accordingly dismissed.
