The judgment rendered by the learned Single Judge which is

impugned in the present appeal, was passed on 06.07.2020. The

present appeal which is filed on or around 21.10.2020 falls within

the Corona exemption period provided by the Supreme Court by

its plenary order dated 23.03.2020. The objection raised by the

Registry is, therefore, overruled.

In the impugned judgment, the learned Single Judge has

relied upon and followed the decision in case of Ashwini Kumar

Yadav Vs. State of Rajasthan and Others, (S.B. Civil Writ Petition

No.22993/2017) as affirmed by the Division Bench by judgment

(2 of 2) [SAW-464/2020]

dated 17.09.2019 in the case of State of Rajasthan and Others Vs.

Serve Shree Om Shiv Neelkanth (D.B. Civil Special Appeal (W)

No.975/2018).

Learned Additional Advocate General candidly stated that the

issue was carried before the Supreme Court and the SLP in the

case of State of Rajasthan and Others Vs. Serve Shree Om Shiv

Neelkanth Associate Etc. came to be dismissed on 15.10.2020.

In that view of the matter, this appeal is dismissed without

recording separate reasons.
