The matter comes up for consideration of the application (IA

No.2/19) preferred on behalf of the petitioner with a prayer to

allow this writ petition in terms of the judgment passed by a co-

ordinate Bench of this Court on 13.12.2013 in S.B. Civil Writ

Petition No.8660/2011 Jitendra Kumar Vs. Jai Narain Vyas

University, Jodhpur & Anr. and judgment passed on 18.07.2014 in

DB Civil Special Apeal No.354/2014 Jai Narain Vyas University,

Jodhpur & Anr through its Registrar Vs. Jitendra Kumar.

Learned counsel for the respondent- University has

submitted that the ratio laid down by this Court in Jitendra

Kumar's case (supra) is not applicable in the case of the petitioner

as he was appointed on the post of LDC through a placement

agency.

While challenging the decision passed by the learned Single

Judge in Jitendra Kumar case's case, similar argument was raised

by the University before the Division Bench, however, the Division

Bench has negated the said argument and upheld the order dated

13.12.2013 passed by a co-ordinate Bench of this Court in S.B.

Civil Writ Petition No.8660/2011 Jitendra Kumar Vs. Jai Narain

Vyas University, Jodhpur & Anr.

In view of the above, I deem it appropriate to allow this writ

petition in terms of the judgment passed by a co-ordinate Bench

of this Court on 13.12.2013 in S.B. Civil Writ Petition

No.8660/2011 Jitendra Kumar V. Jai Narain Vyas University,

Jodhpur & Anr.

Ordered accordingly.

All pending applications are disposed of.
