1. Pursuant to the directions given by this Court on
01.09.2021, the matter was referred to the Mediation Centre of
this Court. With the persuation of Mediator - Mr. MR Pareek and
active assistance of the learned counsel, the parties have been
persuaded to arrive at an amicable settlement and consequently
the long drawn dispute between the parties stands resolved.
2. Learned Mediator drew the terms of settlement in presence
of both the parties, duly identified by rival counsel - Mr. Parihar
and Mr. Dave.
3. The terms of the settlement are reproduced hereunder :-
"(i) Both the parties agreed to settle the dispute of
partisan (sic.) 'partition' of land situated in Khata
(2 of 4) [CW-10483/2020]
No.323, 286 & 284 situated in village Pindwara, Tehsil
Pindwara, Dist.- Sirohi.
(ii) The disputed land of above Khata is allocated to
the petitioner & respondent as follows :-
(a) Land to go to respondent Darjing Ji S/o Dhula Ji by
caste Rajpurohit is :

(iii) Moreover, to irrigate the land situated in Khasra
No.3976/1615 & 3917/1616, pipe line would be laid with
the cooperation of both the parties. This pipe line shall
come from the well situated in Khasra No.1637.
(iv) Electric connection of well situated in Khasra
No.1637 shall be transferred in the name of Darjing Ji S/
o Dhula Ji and Electric Connection of well situated in
Khasra No.1635 shall be transferred in the name of
Dungaram Ji S/o Natha Ji.
(v) Apart from it Petitioner Dungaram Ji shall transfer
half of his share in Land situated in Khata No.119 (old)
124 to the respondent Darjing Ji S/o Dhula Ji. The
Khasra No. of this land are 1609, 1610, 1617, 1635,
1637, 3914/478 and 3915/479."
4. The present writ petition stands disposed of in terms of the
settlement aforesaid.

5. The parties shall abide by the above referred terms.
6. The trial Court i.e., Assistant Collector, Pindwara, District
Sirohi, is directed to draw a decree in terms of the order instant.
Needful be done within a period of four weeks of production of a
certified copy of the order instant.
7. While parting with the judgment, this Court records
appreciation for the efforts of Mr. MR Pareek, Advocate, learned
Mediator, due to whose efforts, the parties have amicably settled
the dispute.
8. Stay petition also stands disposed of accordingly.
