Judgment

1. By way of the present writ petition, the petitioner has

challenged rejection of her candidature under the PH. Category

(Annex.9).

2. The facts appertain are that the petitioner applied for the

post of Health Worker (Female) pursuant to recruitment

notification dated 18.06.2018 while staking her claim against the

seats meant for persons with disability.

3. Alongwith her application form and the present writ petition,

the petitioner has enclosed a certificate dated 30.08.2010 showing

herself to be 60% disabled.

(2 of 2) [CW-3025/2020]

4. A perusal of the recruitment notification shows that the

reservation is for the persons having locomotor disability between

40% to 70% in one leg.

5. Mr. Swami, learned counsel for the petitioner contended that

the petitioner is having more than 60% disability and thus entitled

for reservation under PH category.

6. A simple look at the certificate dated 30.08.2010 reveals

that petitioner is having 60% impairment/permanent disability in

speech and hearing.

7. This being the position, the petitioner is not entitled for

claiming reservation, which is meant for persons with locomotor

disability in one leg, whereas the petitioner's disability is speech

and hearing.
