Heard on merits.
Considering the overall facts and circumstances as available on record, I am of the opinion that it is a fit case for granting leave to the appellant for filing appeal against the impugned judgment of acquittal dated 11.12.2018 passed by learned Special Judicial Magistrate, NI Act Cases, No.3, Bikaner in Criminal Regular Case No.257/2016. The leave to appeal application shall be registered as an appeal.
Admit.
Let bailable warrant in the sum of Rs.30,000/- be issued against the accused-respondent No.2 Prakash Nirmal @ Lalji so as to secure his presence in this Court. Rule is made returnable within six weeks.
