Learned counsel Shri Vishal Sharma representing the

appellants states that he has moved an application for amending

of appeal and to treat the same as one filed under Section 11 of

the Probation of Offenders Act, 1958. The application is allowed

for the reason mentioned therein.

Issue notice to the respondents.

Send for the record.

Heard on the stay application.

The appellate court while accepting the appeal of the

complainant has imposed significant amount to the tune of

(2 of 2) [CRLAS-537/2021]

Rs.40,000/- (in all) by way of prosecution cost upon the

appellants while releasing them on probation.

In view of the facts and circumstances as available on

record, it is hereby directed that the effect and execution of the

said direction given by the appellate court in the judgment dated

08.04.2021 passed in Criminal Appeal No.01/2017 shall remain

stayed till next date of hearing.

List on 16.08.2021.
